1. Acceptance of Terms
Welcome to Hire Expectations! You’ll find below the legal speak that clarifies the details of the rental agreement. We’ve tried to make it as understandable as possible for those of us without a law degree.
These terms govern your use of the Hire Expectations service and the borrowing of garments (the "Service"). By using the Service, you accept these terms and any modifications that may be made to them from time to time; if you do not agree to these terms you should not use the Service.
These terms constitute a binding legal agreement between you and Hire Expectations. ("Hire Expectations," "we," "us," and "our"). Please read them carefully as they include circumstances where you will be liable for additional charges and also some exclusions and limitations on Hire Expectations’ liability.
You should print a copy of these terms and conditions for future reference in connection with your order. We reserve the right to modify the terms at any time so we cannot guarantee that each order you place will be subject to the same terms. Therefore, you should read and print the terms on each occasion that you use the Service.
Unfortunately, we do not currently accept orders from addresses outside the United Kingdom. By placing an order through this website, you warrant that:
(a) you are at least 18 years old;
(b) you are resident in the United Kingdom; and
(c) you are accessing the website from the United Kingdom.
2. The Hire Expectations Service
The Service allows you to borrow garments from Hire Expectations in accordance with these terms.
You can choose and then request garments to borrow from our on-line selection, and request them to be delivered to your address. Dress rental periods are for 5 or 10 days and the return date is specified within the delivery documents.
After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to hire a garment. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the relevant garment has been dispatched (Dispatch Confirmation). The contract between us (Contract) will only be formed when we send you the Dispatch Confirmation or the relevant garments have been delivered. All garments must be signed for upon receipt.
We reserve the right to limit the number of items that you may borrow at any time. The currently available borrowing options and prices, are outlined in detail on the website. Also, the current policies governing the delivery and return of products are detailed on the website. Delivery times for garments you have requested to borrow may vary based upon (a) stock availability, (b) your delivery address, (c) when you place an order, and (d) other circumstances impacting delivery. Accordingly, Hire Expectations makes no guarantees as to actual delivery time.
We deliver to all addresses served by Royal Mail. For certain remote areas, delivery may take up to an extra 3 days.
The products will be delivered “ready to wear”. We clean and inspect each garment on its return, but garments are at your own risk from the time of delivery and Hire Expectations shall not be held liable for any health-related complaints associated with any product (for example (but without limitation) if you are allergic to any cleaning products used in relation to the garments). Garments may appear different in colour and style than the photos displayed on our Site.
Any discounts, vouchers or offers made available on the site or through third party channels which are redeemable on the Hire Expectations site are subject to change without notice and subject to any terms published with such discounts, vouchers or offers. It is hereby confirmed that only one may be used at a time; this will also be subject to change at Hire Expectations' discretion
If you elect to use the “Try on in advance service” you will be charged a maximum of £15.00 for return shipment of up to 2 garments. Garments not returned within the agreed 2 day timeframe or failure to return the garments will result in the same charges as with the standard rental agreement (Clause 4).
3. Paying for the Service
When you borrow a dress you will be required to provide Hire Expectations with accurate, complete and current payment details (credit or debit card or PayPal details) which you are authorised to use. By using the Service, you authorise Hire Expectations and/or its agent to charge to your credit or debit card (as applicable) the relevant fees (per-item or borrowing fees), delivery charges, any and all applicable taxes, and any other charges you may incur in connection with your use of the Service. The applicable fees will be charged to your credit or debit card (as applicable) at the point at which your order is placed either on the website, or over the phone. If your dress is not returned on the relevant due return date, Hire Expectations may charge your credit or debit card for each overdue day, at the rate set for that dress as stated on the website, until Hire Expectations receives the garment back. Your maximum liability for a failure to return the garment is limited to the Recommended Retail Price for that garment. The product replacement fee will vary depending on the dress and will be determined by Hire Expectations at its discretion.
If Hire Expectations does not receive payment from your credit or debit card provider or if your credit card expires or is rejected, you agree to pay all amounts due upon demand. Hire Expectations reserves the right to take all steps necessary to collect amounts due from you, including but not limited to using third party collection agencies. Hire Expectations reserves the right to correct any errors or mistakes that it makes even if it has already requested or received payment.
You are solely responsible for any and all fees charged to your credit or debit card by the issuer, bank, or financial institution including, but not limited to, overdraft, insufficient funds, and over the credit limit fees.
You agree to notify us about any dispute or discrepancies in relation to your charges within 90 days of the relevant garment(s) being delivered to you. If you do not bring them to our attention within such period, you agree that you waive your right to dispute such problems or discrepancies.
Save in relation to any order which has been accepted by us, we may modify the price, content, or nature of the Service at any time.
4. Cancellation: Costs and Refunds
You may cancel your rental order free of charge at any point prior to dispatch of the garment.
After we have dispatched the garment and subject to the strict condition that the garment is unworn, in the same condition as it was delivered to you and all tags are intact and undamaged, you may also return the garment and obtain a full refund including rental fee and delivery costs, as long as you contact Hire Expectations customer service by email to email@example.com by 12 midday on the day following delivery. You will be responsible for the return postage cost in such circumstances, which will be deducted from the amount refunded to you. The postal fee to return the dress depends on the weight of the dresses and is charged at My Hermes face value.
If you wish to exercise the cancellation right referred to above, you must deposit the dress for return, at a post office on the day following delivery. Unless otherwise approved by Hire Expectations, should a product be kept longer than this, Hire Expectations reserves the right to charge the full rental fee. Hire Expectations will process the refund usually within 14 days (maximum of 30 days) of a request for a refund unless the order is being disputed. We will usually refund any money received from you using the same method originally used by you to pay for your purchase. All garment tags MUST remain intact and undamaged and attached to the garment if you wish to return such garment in accordance with this clause.
5. Price, payment and identification
Payment for all orders must be made by credit card, debit card or PayPal on the payment page. We accept payment by most major credit or debit cards. Customers are permitted to have the product delivered to either their credit card billing address or a third party address. For deliveries to addresses other than the billing address e.g. place of work or hotel, Hire Expectations may request additional proof of identity. We can only accept Payment Methods where the statement address is within the United Kingdom.
Our site contains a large number of garments and it is always possible that, despite our best efforts, some of the garments listed on our website may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a garment's correct price is less than our stated price, we will charge the lower amount when dispatching the garment to you. If a garment’s correct price is higher than the price stated on our website, we will normally, at our discretion, either contact you for instructions before dispatching the garment or reject your order and notify you that we are rejecting it. If the pricing error is obvious and unmistakeable and could have reasonably recognised by you as an error, we do not have to provide the garments to you at the incorrect (lower) price.
If a garment is returned in a damaged condition, but one which can be rectified by tailoring, you agree that Hire Expectations may charge your credit or debit card a tailoring fee of £25. If the garment is returned in a damaged or dirty condition that exceeds minor accidental damage as determined by Hire Expectations in its sole discretion, you agree that Hire Expectations may charge your credit or debit card up to the full Recommended Retail Price for that garment. The garment replacement fee will vary depending on the dress and will be determined by Hire Expectations at its discretion.
Under no circumstances are you to attempt to iron or clean any garment yourself by any means (dry cleaned or otherwise). If you do so, Hire Expectations reserves the right to charge your credit or debit card (as applicable) part or full Recommended Retail Price of the garment and charge you the full amount of any potential lost earnings or incurred costs if any damage has been caused and/or we suffer any losses. This includes, but is not limited to, any sums we incur because the garment is not available for other customers to borrow.
8. Disclaimers of Warranties; Limitations on Liability
If we fail to comply with these terms, we shall only be liable to you for the direct and measurable losses suffered by you, which will normally result in a full or partial refund of the price paid by you for the relevant garments. In any event, our maximum liability shall not exceed the price paid by you (including delivery charges) for the relevant garment(s) ordered by you.
We will not be liable for indirect or consequential losses that result from our failure to comply with these terms and conditions.
Nothing in these terms exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation or any other matter for which it would be illegal for us to exclude or attempt to exclude our liability.
Prices are exclusive of VAT which, if applicable, will be charged in addition. The total price payable by you (including any applicable VAT) will be set out in your order before you submit your hire request.
10. Transfer of Rights and Obligation
You may not transfer or otherwise dispose of the Contract, or any of your rights or obligations arising under it, without our prior written consent.
11. Events Outside Our Control
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under any Contract that is caused by events outside our reasonable control (Force Majeure Event).
A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
(a) fire, explosion, storm, flood, earthquake, subsidence, epidemic or a natural disaster;
(b) impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
(c) impossibility of the use of public or private telecommunications networks; and
(d) the acts, decrees, legislation, regulations or restrictions of any government.
Unfortunately, the Service relies on other customers returning garments on time. If and to the extent that another customer fails to return an item by the due date for return and this affects your order, we will treat this as a Force Majeure Event.
Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event. If the Force Majeure Event is caused by the non-return of a garment by another customer, we will offer to supply you with an alternative garment for no additional charge or else offer you a full refund (and this shall be the full extent of our liability).
